Important Dates and Deadlines

Objections to the Settlement

Objections to the Settlement must be made on or before February 2, 2004.  For more information, please refer to Section 7 of the Settlement Notice.

Settlement Fairness Hearing

A hearing is scheduled to be held by the Court on February 27, 2004 at 2:00 p.m., in Department 74, 330 West Broadway, San Diego, California, in order to consider whether to give the Settlement final approval. 

Settlement Claim Form

In order to participate in the distribution of the Settlement Fund, you must  file a valid Claim Form with the Claims Administrator postmarked no later than September 24, 2004.

PLEASE READ THIS COURT ORDERED CLASS ACTION NOTICE

If you paid a fine, penalty, attorneys' fees or forfeited bail as a result of a citation issued from a red light automated enforcement system operated in California, you may be a member of a Class Action lawsuit. At this time, you do not have to do anything to remain a Class Member. This is to inform you of the Court's certification of two Plaintiff Classes, the nature of Plaintiffs' claims, and your right to participate in the proposed Settlement.

WHAT IS THIS CASE ABOUT?

The Class Representatives claim that the red light photo enforcement systems operated in certain California cities are illegal because (1) they are operated by a private, for-profit corporation instead of government agencies in cooperation with law enforcement; and (2) the private, for-profit corporation is paid if money is collected from the red light ticket. The Class Representatives seek to recover fines, penalties, attorneys' fees or forfeited bail and that Class Members paid as a result of the citation, punitive damages, restitution, a declaration that the Defendants' conduct is illegal and an order from the Court prohibiting the Defendants from continuing these practices. Defendants deny all allegations of wrongdoing.

The Court has made no determination of the merits of Plaintiffs' or Defendants' case.
